When I moderated on a large forum, there were a number of incidences of people using copyrighted photos for their photo manips and signatures. This resulted in the owner of one of the copyrighted photographs finding the website, and threatening to open a lawsuit against it.
This may be an extreme example, but equally it isn't polite to use a photo which someone doesn't want modified.
